Judicial Systems in Transition Economies: Assessing the Past, Looking to the Future - Livres de poche

ISBN: 0821361899

[SR: 5488159], Paperback, [EAN: 9780821361894], World Bank Publications, World Bank Publications, Book, [PU: World Bank Publications], World Bank Publications, 'Judicial Systems in Transition Economies' looks at the experience of countries in Central and Eastern Europe and the Baltics (CEE) and the Commonwealth of Independent States (CIS) as they reform their legal and judicial institutions to fit the needs of a market economy. The study shows, rather disturbingly, that less progress has been made in judicial reform than in most other areas of institutional reform in these countries. The transition from socialism to capitalism requires a fundamental reorientation of legal and judicial institutions. This study reviews the environment preceding reforms, forces that provoked and supported them, and the reform agendas undertaken in these countries since 1990. Against this background, it exposes the impact of reforms, implementation gaps, and the underlying determinants of success and failure. The report examines how courts have performed, and reveals their impact on public opinion and the business environment. It provides insight into linkages among reforms as well as linkages between reforms and public demand for a fair judiciary. The authors show that while each country presents different challenges and opportunities, certain lessons apply in most settings. Their insights and data would be useful to policy makers, judicial personnel, and those involved in reforming judiciaries. The study draws on numerous data sources. These include the World Bank, the European Bank for Reconstruction and Development (EBRD, the American Bar Association-Central European and Eurasian Law Initiative (ABA-CEELI), the World Values Survey, the World Economic Forum, and the University of Strathclyde., 2594, Economics, 2657, International, 3, Business & Money, 1000, Subjects, 283155, Books, 10900, Jurisprudence, 173495, Legal Theory & Systems, 10777, Law, 1000, Subjects, 283155, Books, 16022411, Philosophy, 10777, Law, 1000, Subjects, 283155, Books, 21, Reference, 11444, Almanacs & Yearbooks, 11448, Atlases & Maps, 2572, Careers, 11626, Catalogs & Directories, 11472, Consumer Guides, 11475, Dictionaries & Thesauruses, 11713, Encyclopedias & Subject Guides, 11823, English as a Second Language, 11761, Etiquette, 11773, Foreign Language Study & Reference, 11880, Genealogy, 11902, Quotations, 8975382011, Survival & Emergency Preparedness, 5267710011, Test Preparation, 11970, Words, Language & Grammar, 5267707011, Writing, Research & Publishing Guides, 1000, Subjects, 283155, Books, 5571267011, Asian, 11093, International & World Politics, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 5571271011, European, 11093, International & World Politics, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 10580, Social Services & Welfare, 5571275011, Public Affairs & Policy, 5571255011, Politics & Government, 3377866011, Politics & Social Sciences, 1000, Subjects, 283155, Books, 491584, Economics, 491586, Economic Theory, 491590, Macroeconomics, 491592, Microeconomics, 468220, Business & Finance, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books, 684246011, International Business, 468220, Business & Finance, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books, 468222, Law, 491506, Business Law, 491510, Constitutional Law, 491512, Criminal Law, 491516, Legal Reference, 491514, Tax Law, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books, 491474, Public Policy, 491464, Political Science, 468214, Social Sciences, 465600, New, Used & Rental Textbooks, 2349030011, Specialty Boutique, 283155, Books

Détails sur le livre
Judicial Systems in Transition Economies: Assessing the Past, Looking to the Future
Auteur:

Anderson, James; Bernstein, David; Gray, Cheryl

Titre:

Judicial Systems in Transition Economies: Assessing the Past, Looking to the Future

ISBN:

9780821361894

This study reviews the experience of countries in Central and Eastern Europe and the former Soviet Union in reforming their judicial systems to fit the needs of a market economy. It is probably fair to say that less overall progress has been made in judicial strengthening than in almost any other area of policy or institutional reform since 1990. Countries and donors are now placing increasing emphasis on the need to improve the independence, efficiency, accountability, and enforcement capacity of judicial institutions. Transition countries vary significantly--not only in the specific problems they face but also in both judicial capacity and in the "demand" by the public for well-functioning judiciaries. The strategy and priorities for each country going forward will depend in large part on its particular situation.
